Update on EFS top ten filing errors post

Follow up to a previous post “EFS Filing Errors…the top ten,” the USPTO has (via e-mail) clarified their previous information:

EFS-Web Document Indexing Special Update

The United States Patent
and Trademark Office (USPTO) distributed an e-Alert on June 19th and
provided ten of the most common e-filing mistakes in the “Did you
know?” section. Based on feedback received, the USPTO would like to
clarify the following document indexing e-filing mistake:

*       Not indexing their Amendment parts correctly
*
      Index the coversheet/transmittal letter using the Amendment type
document descriptions (i.e. Amendment after Non-Final, Preliminary
Amendment).
*       Index the marked up copy of the amended
application part based on the application part (i.e. specification,
claims, drawings).
*       Index any arguments or remarks as “Applicant Arguments/Remarks made in Amendment”)
