Accelerated Examination of Patents. Good idea? Bad?

by Stephen M. Nipper. | Posted in USPTO   Comments Off

I haven’t reviewed this topic enough to form an opinion one way or another (as to how it would benefit/harm MY clients)…yet.  However, if you’d like to learn more:

The United States Patent & Trademark Office [USPTO] invites you to participate in a special web announcement on Thursday, November 2nd at 2 p.m. Eastern / 11 a.m. Pacific on the USPTO’s revised Accelerated Examination [AE] program.

If you have already enrolled, thank you and we look forward to your attendance on November 2nd.

As of August 25th, 2006, the USPTO has established procedures under which the examination of a patent application may be accelerated, leading to a final decision by the examiner within 12 months from the application filing date.

To learn more about the new Accelerated Examination Program, and the specific requirements to participate in it, please register for this free online event by clicking on the following link:

https://websurveyor.net/wsb.dll/39376/AccExamAnnEnrollmentForm.htm

During this live one-hour web cast event, USPTO personnel will review important components of AE including:

  • The benefits to the applicant
  • New requirements to make special which apply to all patent applications
  • New processing and examination procedures
  • Additional information required by the new AE process
  • Accelerated response time mandated by the process
  • Brief review of how to file under the new program using EFS-Web

The presentation and audio for this event will be streamed to you over the internet. All you will need to participate is a computer with an internet connection, sound card, speakers and the ability to view Windows Media presentations.

Remember, this web announcement will be held Thursday, November 2nd at 2 p.m. Eastern/11 a.m. Pacific and requires registration. Don’t miss this important opportunity to learn more about Accelerated Examination from the USPTO personnel.

Acrobat 8 for Lawyers

by Stephen M. Nipper. | Posted in Business & Tech Tips   1 Comment »

This last year I bought a Fujitsu ScanSnap scanner (which comes with Acrobat for free).  Probably the best investment I made last year…can’t imagine practicing law without a desktop scanner/Acrobat.

Looks like the forthcoming version of Adobe Acrobat has a number of features that lawyers will find VERY useful.  The main ones being integral Bates numbering and redaction.

Adobe is putting on a free presentation for lawyers on the new features on Tuesday, October 24, 2006, if any of you are interested:  “Acrobat 8 for Legal Professionals.”

My paralegal sat through EFS-Web training yesterday (or was it Wednesday?).  One thing she took away was a warning:

Advent Product Development sued for fraud, improper and deceptive invention promotion

by nipper. | Posted in Info For Inventors, Litigation/Legislation/Regulation   42 Comments »

Via Patent Lawsuit Updates — RSSMojo, I noticed two patent infringement lawsuits filed recently by former customers of Advent Product Development:

PAPPALARDO v. ADVENT PRODUCT DEVELOPMENT, INC.  [Complaint—File Attachment: pappalardo.pdf (18 KB)]
njdce
1:2006cv04697
2006-09-29

PRIOLEAU v. ADVENT PRODUCT DEVELOPMENT, INC.  [Complaint—File Attachment: PRIOLEAU.pdf (18 KB)]
njdce
1:2006cv04698
2006-09-29

The complaints, filed by same attorney, include causes of action for:

  • Improper and Deceptive Invention Promotion
  • Violation of the New Jersey Consumer Fraud Act
  • Common Law Fraud

How Advent responds and how the case turns out is yet to be seen, but one could follow the cases (using the above information) via PACER:  http://pacer.psc.uscourts.gov/

[update: I understand that the court upheld the forum selection clause in the contract, forcing the case to be transferred to Advent's home forum (South Carolina). The Plaintiff (inventor) gave up, filing a Motion to Dismiss, which was granted. Link to: copy of the Dismissal Order.]

IP Bookmarks ==> Wiki

by Stephen M. Nipper. | Posted in IP Law Practice   Comments Off

07112030735“>Stephan Kinsella has, for some time, maintained an extensive list of IP bookmarks.  Via email earlier, he indicated that he has decided to take his list and make it a wiki…letting the community help him add additional resources for patent practitioners.

The Intellectual Property, Patent, and Law Resources previously shown below has been moved to a PatentLawPractice wiki at Wikispaces.

Members of the patent and IP law community are encouraged to help improve it. To do this, first, join Wikispaces then join the PatentLawPractice Wiki.

The wiki is designed for the patent bar and IP law community–practicing IP attorneys or patent agents, and, on a limited basis, others with special familiarity with IP law practice.

(IP practitioners who have not yet members are also encouraged to join the PatentLawPractice Yahoo Group listserv.)

The PatentLawPractice Yahoo Group is a great resource itself.  If you are a practitioner…it is highly recommended.

Setting Up Blogads In TypePad TypeLists

by Stephen M. Nipper. | Posted in Business & Tech Tips   1 Comment »

Earlier, I set up a new Blogads strip (with an ad for our legal jobs board (www.legalmojo.com)) over in the right hand margin of this blog.  I’ve really enjoyed using Blogads…revenue from it has been used to fund my share of the development costs of various Rethink(IP) projects (like LegalMojo, LawsuitMojo, PatentFizz, etc.).  Let me know if you want to chat (privately) about my experience with Blogads.  Anyway…

As part of my community service (helping fellow bloggers and their future Google searches), I thought I’d explain how to set up a Blogads ad in as a TypePad TypeList.  (To my non-blogging readers…please pardon the interruption):

1.         Log-in to your TypePad Account.

2.         Go to your TypeLists:  http://www.typepad.com/t/app/lists

3.         Select “Create a new TypeList.”

a.  List Type:  Link

b.  List Name:  Blogads (or whatever else you want to name it)

c.  click “Create New List” button

4.         Under “Manage” select “Add new item”

5.         Skip all boxes and go to “Notes”

6.         Enter the code Blogads gives you into “Notes”, i.e.:

<link rel=”stylesheet” type=”text/css” href=”http://cache.blogads.com/xxxxxxx/feed.css” /> <script language=”javascript” src=”http://cache.blogads.com/xxxxxxxx/feed.js”></script>

[note:  use your own code…not the code with “xxxxxxxx” in it pasted here]

7.                  Click “save item.”

8.                  Click “close window.”  That should bring you back to the main window for your new Blogads TypeList.

9.                  Now click on the “Configure” tab.

10.              Under “2.  Advanced Configuration” you need to change “Display Notes” to be “As Text” (that way the Blogads code shows up as code).

11.              Click “Save Changes”

12.              So…now you have a TypeList with your Blogads code in it.  Last step is to get the TypeList to show up on your blog.  If you don’t know how to do that, see TypePad’s article on “Displaying TypeLists on Your Weblog

Speed dating: Inventors and Investors

by Stephen M. Nipper. | Posted in Info For Inventors   Comments Off

“Speed dating” is a concept where “men and women are rotated to meet each other for only eight minutes. At the end of each eight minutes, they are forced to the next round no matter how much they are enjoying the interaction (or dread the next one). At the end of the event participants submit to the organizers a list of who they would like to provide their contact information to. To maximize the number of interactions, organizers often depart from the original idea and set meeting times as low as one minute per person. If there is a match, contact information is forwarded to both parties. Contact information cannot be traded during the initial meeting, in order to reduce pressure (especially on women) to accept or reject a suitor to their face.”

The Boise entrepreneur group “Kickstand” has a great idea…why not try inventors and investors speed dating?

Kick_stand_logo

Twice a year we sponsor a confidential event we’ve named Start-up Speed Dating as part of our mission: “to support innovators in any industry who would like to benefit from the experience, contacts and successes of other entrepreneurs.” Selected companies have the opportunity to pitch their business model to a variety of experienced investors in a speed dating format. The application process is simple and there are no strings (or fees) attached. We invite you to apply to participate in this month’s event.
