Hal Wegner (Foley & Lardner) has written an amazing (102 page long) paper called “Claim Construction: Toward a Simplified and Predictable Body of Patent Law,” for a Foley & Lardner Intellectual Property Roundtable in Detroit, September 14, 2004. The paper provides a comparative view of the United States claim construction exercise, focusing on some of the issues under consideration in the en banc claim construction case at the Federal Circuit — the Phillips case.
