Carl Oppedahl has an article entitled “New Hazards Regarding Title and Security Interest Opinions [pdf].” The article provides an excellent discussion of how long it takes to get an assignment recorded (paper vs. fax vs. electronic) and the ramifications of such timing on security interest opinions. Great article.
